Wills + Estates

Dan Hawkwood offers services including the preparation of wills, probate of estates on behalf of executors, and facilitating applications for Guardianship and Trusteeship under the Alberta Guardianship and Trusteeship Act.

Wills

The assistance and advice of a lawyer in preparing your will is vital in ensuring that your assets are distributed as according to your wishes. Particularly, we can advise you of the best ways to organize your Estate to ensure that any tax consequences are properly considered, and any investments, corporations, or other unique property you may own is dealt with correctly. We also offer advice on enduring power of attorney and personal directive documents, which serve to appoint an individual to make financial and personal decisions on your behalf should you suffer a serious injury, health issue, or otherwise be unable to make such decisions on your own.

Guardianship and Trusteeship

As individuals age, it may become necessary for their families to make important decisions on their behalf. The Alberta Guardianship and Trusteeship Act provides a mechanism for individuals to assist their loved ones with their financial, personal and medical decisions when they are no longer capable of doing so themselves. There are a range of options available, from less intrusive measures such as supported decision making or co-decision making, to full Guardianship and Trusteeship. Dan has extensive experience in this area and can assist you in navigating the Guardianship and Trusteeship process. This includes reviewing the various options with you, and applying to Court for a new Guardianship or Trusteeship order, or renewing a previously granted order.

Estate Executors and Probate

We provide services to Estate Executors to assist them in ensuring that the wishes of the deceased are carried out correctly and efficiently. These services include drafting applications for probate, advising on the interpretation of the will, and assisting in the administration and disposition of Estate assets.
